DMCA Policy
What Happened To Maxim Naumov Parents ("WHMNA") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are reported to our designated Copyright Agent.
This policy describes the information that should be present in a DMCA notice and counter-notification. We reserve the right to remove any content without prior notice and at our sole discretion.
Filing a DMCA Copyright Infringement Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the WHMNA website, please notify our Copyright Agent with the following information (the "DMCA Notice"). Your notice must be a written communication provided to our agent and must substantially include the following:
- Identification of the copyrighted work claimed to have been infringed: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing: A description of where the material that you claim is infringing is located on the WHMNA website, with enough detail that we may find it. Providing URLs is the best way to help us locate content quickly.
- Your contact information: Your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
- Your physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA Notice, WHMNA will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the site.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Copyright Agent (a "Counter-Notice"). Your Counter-Notice must be a written communication that includes substantially the following:
- Identification of the material: Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your name, mailing address, telephone number, and email address.
- A statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which 'What Happened To Maxim Naumov Parents' may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your physical or electronic signature: Your physical or electronic signature.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.
